LIMITATION OF LIABILITY Rewards Program Administrator, MLB Entities and PDL Entities (as defined below) specifically disclaim any liability (whether based in contract, tort, strict liability or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the website (even if Rewards Program Administrator has been advised of the possibility of such damages) including liability associated with any viruses which may infect a user's computer equipment. Rewards Program Administrator, MLB Entities and PDL Entities do not maintain any control over the manufacturers or suppliers of awards merchandise, the issuers of gift cards or tickets, or over the personnel, equipment or operations of any air, water or surface carrier, ship line, transportation company, hotel, restaurant, tour company, or other person or entity providing travel services, general services, gift cards, products or accommodations as an award, because all suppliers offering products and/or services through the rewards program are independent contractors. Accordingly, Rewards Program Administrator, MLB Entities and PDL Entities do not make any guarantees, warranties or representations of any kind, expressed or implied, with respect to products, services or merchandise, nor does Rewards Program Administrator, MLB Entities and PDL Entities accept any liability for any loss, expense, damage or injury incurred as a result of any defect in or failure of such items. In no event will Rewards Program Administrator be liable for any punitive, special, indirect, or consequential damages.

TICKET TERMS & CONDITIONS:

USER ACCEPTS RISK OF ILLNESS/INJURY; NO RE-ENTRY

By using this ticket, holder, on their behalf and on behalf of any minor (“Minor”) and any accompanying party for whom holder retains a ticket to attend the Event (defined below) (each of whom holder represents authorized holder to act on their behalf in accepting applicable Agreement terms) (with Minor, “Accompanying Parties”), agrees to the terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE/CLASS ACTION WAIVER, and the Agreement summary below (Agreement controls if any conflict). Holder and Accompanying Parties are, collectively, “Holder”.

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER (1) ASSUMES ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) WILL COMPLY WITH HEALTH/SAFETY POLICIES OF CLUB AND HOST VENUE OWNER/OPERATOR.

Minor League Baseball game/event/exhibition dates and times are determined in the sole discretion of the PDL and/or the applicable PDL Club and may be subject to change. The terms and conditions of the tickets awarded as part of any offer will govern in the event a legal game/event/exhibition, as defined by PDL, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each ticket recipient and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the offer. PDL Entities reserve the right to remove or to deny entry to any ticket recipient and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Releasees (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Minor League Baseball game/event/exhibition. Minor League Baseball game/event/exhibition tickets distributed as part of this offer may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and ticket forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

Holder will comply with all applicable Minor League Baseball Club (each, the “Club”) and host venue policies & protocols. Holder will not transmit/aid in transmitting photographs, images, videos, audio, livestreams or other accounts/descriptions (including play-by-play data) (whether text, data or visual), in any media, about the game/event or related attractions (collectively, “Event”). Holder consents to and waives compensation for use of their image or other personality rights and consents to security searches/screening. MLB Entities and PDL Entities reserve the right to revoke this license without refund and refuse admission/eject anyone who (a) violates Agreement terms; (b) appears to be or is intoxicated; (c) is deemed by an MLB Entity or PDL Entity to be disorderly or a health/safety risk; or (d) uses vulgar or abusive language.

Holder acknowledges/assumes all risks of attending the Event, including, without limitation, contracting COVID-19 or other communicable disease or being injured by bats, balls or other items. Holder releases Club and all other MLB Entities, PDL Entities-, host venue, ticket provider, and all successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives, licensees, sponsors, vendors and contractors (collectively, “Releasees”), from claims arising out of the Event, even if due to the sole, joint, or comparative negligence, or strict liability, of Releasees (“Released Claims”) and will indemnify Releasees from and against Released Claims. “PDL Entities” means MLB Professional Developments Leagues, LLC (“PDL”), each PDL Club, each of their subsidiaries or affiliated entities, any entity which now or in the future controls, is controlled by, or is under common control with PDL and the PDL Clubs, and all officers, directors, employees, agents, partners, and members of those entities. “MLB Entities” means the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.

HOLDER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO RELEASEES TO THE FULLEST EXTENT PERMITTED BY LAW. IF HOLDER CANNOT AGREE FOR ACCOMPANYING PARTIES, ACCOMPANYING PARTIES MUST LEAVE THE EVENT.

ANY CLAIM RELATED TO THIS TICKET SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, BINDING ARBITRATION. HOLDER MAY NOT JOIN OR CONSOLIDATE CLAIMS OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

This ticket is valid only for this Event; if not played or completed, this ticket will admit Holder to the rescheduled/resumed Event; if not rescheduled/resumed, refunds or credits will be as determined in Club’s discretion.
